Types Of Powers Of Attorney In Arkansas

There are several types of POAs available in Arkansas. Each one serves a different purpose, and our attorney can help determine which is best for your needs. Below are the most common types:

  • Durable power of attorney: Allows someone to act on your behalf even if you become incapacitated.
  • Medical power of attorney: Grants authority to make health care decisions if you are unable to do so.
  • Financial power of attorney: Lets someone manage your money, property or business matters.
  • Limited power of attorney: Provides specific, limited powers for a short time or specific task.

In 2011, the Arkansas Legislature created a Statutory Form for a Power of Attorney under A.C.A. §28-68-301.  That power of attorney resolves most medical and financial issues.  The statutory form provides for limiting the Power of Attorney’s scope. Finally, that same statutory form permits for the naming of a Guardian in the event that you become incapacitated.
