What Is Guardianship In Arkansas?

In Arkansas, guardianship is a court-ordered legal arrangement. A judge appoints a responsible adult to manage the affairs of an incapacitated adult or a minor (e.g., referred to as the ward or protected person). Arkansas courts prefer less restrictive options first, such as powers of attorney or supported decision-making arrangements. However, once the individual is too impaired to make decisions on their own, then a Guardianship is necessary.

Arkansas courts can appoint two types of guardians. A guardian of the person directs personal decisions, including where the ward lives and what medical care they receive. A guardian of the estate manages the ward’s financial matters, including their assets and property.

Not everyone qualifies to serve as a guardian. Arkansas law requires guardians to:
